R E S O L U T I O N

RESOLUTION ST-106 APPROVING ANGELS FLIGHT RAILWAY COMPANY SYSTEM SECURITY PLAN

SUMMARY

This resolution grants the Angels Flight Railway Company's (AFRC) request for approval of its System Security Plan (SSP).

BACKGROUND

General Order 164-D, Rules and Regulations Governing State Safety Oversight of Rail Fixed Guideway Systems, requires each rail transit agency obtain Commission approval of its initial SSP before it begins revenue operations. The AFRC SSP is a document that details AFRC's security policies, objectives, responsibilities, and procedures.

On August 27, 2009, AFRC submitted to Rail Transit Safety Section staff (staff) its initial SSP dated August 21, 2009.

DISCUSSION

Staff reviewed the SSP in accordance with the 31-point checklist of RTSS-3, Procedure for Reviewing, Approving, and Filing Transit Agency Prepared System Security Plans. Staff finds the SSP is in compliance with the 31-point checklist and General Order 164-D. Based upon the results of this review, staff recommends that the Commission grant approval of AFRC SSP.

PROTESTS

No protests or objections have been filed with the Commission.

NOTICE

On October 20, 2009, AFRC's request for approval of its SSP was published on the Commission's Daily Calendar.

COMMENTS

This is an uncontested matter in which the resolution grants the relief requested. Accordingly, pursuant to Section 311(g)(2) of the Public Utilities Code and Rule 41.6(c)(2) of the Commission's Rules of Practice and Procedure, the otherwise applicable 30-day period for public review and comment is waived.

FINDINGS

THEREFORE, IT IS ORDERED THAT:
