On August 9, 2011, the Division of Water and Audits circulated for comment draft Res. W-4885. Comments were due on or before August 30, 2011.

As described in the August 9th letter, draft Resolution (Res.) W-4885 authorizes San Jose Water Company's (SJWC's) request in Advice Letters (ALs) 415 and 415-A to amortize its Mandatory Conservation Revenue Adjustment Memorandum Account (MCRAMA). Because recovery of the MCRAMA would supplement (for the period August 3, 2009 through May 1, 2010) the recovery authorized for SJWC in Decision (D.) 08-08-030, the utility's most recent conservation case1, draft

Res. W-4885 was mailed for comment to the parties to D.08-08-030, in addition to San Jose Water Company (SJWC) and the protestants to ALs 415 and 415-A. (See Public Utilities Code Section 1708.)

We are extending the deadline for the filing of comments on draft Res. W-4885 to provide interested persons an opportunity to provide any additional comments only on the following matter: Any interested person who believes that an evidentiary hearing is needed prior to the Commission issuance of draft Res. W-4885, must submit comments to the Division of Water and Audits requesting such an evidentiary hearing. Any interested person who submits comments requesting an evidentiary hearing must also discuss in these comments the following:

The Division of Water and Audits must receive any comments filed requesting an evidentiary hearing and addressing the reasons for the need for such a hearing, as discussed above, on or before September 12, 2011. Any person filing such comments must submit an original of these comments, with a certificate of service, to:

Interested persons must serve a written or electronic copy of their comments on the utility, SJWC, on the same date that the comments are submitted to the Division of Water and Audits.

In light of this extension for the filing of additional comments, draft Res. W-4885 will now be on the Commission's September 22, 2011 agenda. The Commission may act then on this resolution or it may postpone action until later. When the Commission acts on a draft resolution, the Commission may adopt all or part of the draft resolution, as written, or amend or modify the draft resolution; or the Commission may set the draft resolution aside and prepare a different resolution. Only when the Commission acts does the resolution become binding.

1 D.08-08-030 authorizes for SJWC a Monterey-style Water Revenue Adjustment Mechanism, and the authorization under the draft Resolution W-4885 would essentially provide to SJWC the recovery the utility would have achieved if the Commission had authorized in D.08-08-030 a full decoupling Water Revenue Adjustment Mechanism/Modified Cost Balancing Account ratemaking mechanism for SJWC for the period August 3, 2009 through May 1, 2010.
