Resolution T-17363. Reinstatement of Operating Authorities by Consumer Telecom, Inc. (U-6984-C), Momentum Telecom, Inc. (U-7108-C), Vaya Telecom, Inc. (U-7122-C) and Central Telecom Long Distance, Inc. (U-7127-C).

This Resolution reinstates the Operating Authorities held by Consumer Telecom, Inc. (U-6984-C), Momentum Telecom, Inc. (U-7110-C), Vaya Telecom, Inc. (U-7122-C) and Central Telecom Long Distance, Inc. (U-7127-C).
On April 19, 2012, the Commission adopted Resolution T-17359 which revoked operating authority for telephone corporations in default of CPUC surcharge and User Fee reporting and payment requirements pursuant to PU Code Section 401-435, as well as the performance bond filing requirement [cite]. On March 20, 2012, a Notice of Availability was e-mailed to all telecommunications corporations informing these parties that the draft of Resolution T-17359 was available for public comments. Notice of carrier names on this Resolution also appeared on the PUC's Daily Calendar for 30 days. Interested parties were invited to contact Communications Division (CD) staff with questions or written comments on this Resolution. Subsequently, after the Draft Resolution T-17359 was published, 63 telephone companies became 100% compliant with relevant CPUC requirements. The operating authority of the remaining 106 telephone carriers' was revoked when the Commission approved Resolution T-17359 on April 19, 2012.
Discussion
After the draft resolution was posted, four carriers exerted efforts to correct their deficiencies in User Fee and Surcharge reporting and payment, as well as in the posting of the performance bond. However, CD was able to resolve these carriers' compliance just prior to or on the day the Commission adopted Resolution T-17359. As there may have been a technical timing issue in becoming compliant before the deadline created by the Commission's vote, CD recommends that operating authority be reinstated for Consumer Telecom, Inc. (U-6984-C), Momentum Telecom, Inc. (U-7108-C), Vaya Telecom, Inc. (U-7122-C) and Central Telecom Long Distance, Inc. (U-7127-C).
Consumer Telecom, Inc. reported its user fees using the incorrect utility number and has since demonstrated to the CD staff that it has met payment and performance bond requirements. Momentum Telecom, Inc. and Vaya Telecom, Inc. each have demonstrated compliance with Commission reporting and payment requirements and should be reinstated. Central Telecom Long Distance, Inc. has demonstrated that it met the Commission's performance bond requirement. Since these telephone corporations have now complied with the Commission's reporting requirements, their operating authorities should be reinstated.
Findings
1. Consumer Telecom, Inc. reported its user fees using the incorrect utility number and has demonstrated to the CD staff of its payments and performance bond requirement compliance.
2. Momentum Telecom, Inc. and Vaya Telecom, Inc. each have demonstrated compliance with Commission reporting and payment requirements.
3. Central Telecom Long Distance, Inc. has demonstrated its compliance with the performance bond requirement
4. Resolution T-17359 revoked the operating authorities of Consumer Telecom, Inc., Momentum Telecom, Inc., Vaya Telecom, Inc. and Central Telecom Long Distance, Inc. Since these telephone corporations became compliant with Commission reporting requirements for its User Fee, surcharge and performance bond prior to the Commission's vote on April 19, 2012, their operating authorities should be reinstated.
THEREFORE, IT IS ORDERED that:
1. Consumer Telecom, Inc.'s Operating Authority is reinstated and Utility Identification Number U-6984-C is reissued to the company.
2. Momentum Telecom, Inc.'s Operating Authority is reinstated and Utility Identification Number U-7108-C is reissued to the company.
3. Vaya Telecom, Inc.'s Operating Authority is reinstated and Utility Identification Number U-7122-C is reissued to the company.
4. Central Telecom Long Distance, Inc.'s Operating Authority is reinstated and Utility Identification Number U-7127-C is reissued to the company.
This Resolution is effective today.
