Description: On August 8, 2003, Peter Hayes, Director-Regulatory, Pacific Bell Telephone Company (SBC California), met with Timothy Sullivan, advisor to Cmmr. Kennedy, in San Francisco. Written material (attached to the notice) was used. Hayes stated that the recent ALJs Ruling advances an untenable, new interpretation of the applicability of GO 69-C and must be overturned. Hayes explained that the Ruling denies the legitimate use of GO 69-C in transactions between a utility and its affiliate. Hayes indicated that SBC California believes a revocable license pursuant to GO 69-C is appropriate in this case.

Mitchell stated that, out of an abundance of caution, SBC filed this application seeking authority to lease vacant office space to its affiliate. Mitchell explained that SBC was trying to understand where the Commission drew the line between requiring a Section 851 application and allowing a party to proceed pursuant to General Order 69-C without the need for an 851 application. Mitchell advised the Commission that SBC would withdraw the application.
