On April 7, 2004, Jim Rexroad of North American Power Group, Ltd. (NAPG) met with Karl Bemesderfer, advisor to Cmmr. Kennedy, in San Francisco. Also present was Terry German of Livingston & Mattesich Law Corporation. Written materials (attached to the notice) were used. Rexroad and German stated that NAPG disagrees with the interpretation and application of Public Utilities Code Section 377 as set forth in the proposed decision on grounds that Kern Steam Plant is not an `electrical generating facility? nor a 'generation asset' within the meaning of Section 377. Rexroad and German stated that the transfer of the facility should not be stayed and the determination under Section 851 should proceed without delay. NAPG indicated that, if the draft decision becomes final, without revision, the development of the site will be significantly delayed.
