Description:
On April 28, 2004, John Clark of Goodin, MacBride, Squeri, Ritchie, and Day, LLP, representing Inflexion California Communications Corp. (Inflexion), met with Lester Wong, advisor to Pres. Peevey, in San Francisco. Copies of resumes (attached to the notice) of Inflexion's founders were used. Clark described the errors that are set forth in the pending draft decision, as outlined in Iflexion's filed-comments. Description:
On April 29, 2004, John Clark of Goodin, MacBride, Squeri, Ritchie, and Day, LLP, representing Inflexion California Communications Corp. (Inflexion), delivered substantively-identical letters (a copy attached to the notice) to Cmmr. Kennedy, Timothy Sullivan, advisor to Cmmr. Kennedy, Lester Wong, advisor to Pres. Peevey, and Robert Wullenjohn, advisor to Cmmr. Brown. The letters each transmitted a copy of a February 2002 Washington Post magazine article describing the competitive playing field at the time that Ntegrity Telecontent Services, Inc., a company whose co-founders included two members of Inflexion's current management team, was attempting to operate. In the letter, Clark explains that the purpose of the letter is to provide background context for problems suffered by Ntegrity that led to its cessation of operations and inability to fund a continued defense to action taken by the Pennsylvania Commission against it.

Description:
On April 8, 2004, John Clark of Goodin, MacBride, Squeri, Ritchie, and Day, LLP, representing Inflexion California Communications Corp. (Inflexion), delivered, by facsimile, identical statements (attached to the notice) summarizing issues concerning the draft decision of ALJ Thomas that Inflexion wishes to discuss during ex parte meetings with Cmmrs. Lynch, Peevey, Kennedy, Wood, and Brown. The statements indicate strong opposition to the draft decision on the grounds that it misstates various critical facts, relies on unfounded assumptions, fails to consider important evidence, and was issued without furnishing Inflexion with proper notice and an opportunity to be heard.

On November 13, 2003, Elaine M. Duncan, Vice President General Counsel for Verizon California Inc. (Verizon), spoke by telephone to Karl Bemesderfer, advisor to Cmmr. Kennedy. Duncan stated that Verizon has suffered significant financial losses due to amounts owed by competitive local exchange carriers which were in default or bankruptcy, and that problems and losses caused by defaulting carriers going out of business were issues of serious concern faced by Verizon. Duncan stated that Verizon had filed a petition with the Commission asking it to establish rules to address these concerns.
