Description: On August 17, 2005, Dan L. Carroll, attorney for the Merced Irrigation District and Modesto Irrigation District, had two separate telephone conversations: with Julie Fitch, advisor to Pres. Peevey, and David Gamson, advisor to Cmmr. Brown. Carroll stated that the Districts do not oppose economic development rate programs as long as they are fair and competitively neutral. Carroll noted that the proposed alternate decision (AD) of Cmmr. Kennedy with respect to economic development rates is vague in terms of the proposals to be adopted by the Commission. Carroll specified that most parties agree that the Commission should adopt the Joint Utility Proposal and revisions to the AD are necessary to reflect that. Carroll also explained that a number of issues were litigated in the proceeding which are not addressed in the AD, but should be.
