Mattes stated that it was important to Whispering Hills that the Commission issue a decision without unnecessary delay but also stated that Whispering Hills understood and supported San Diego Gas & Electric Company's (SDG&E) position that the DD could set an unfortunate precedent by requiring renegotiation of an agreed upon sales price without substantial evidence that such price was inadequate. Mattes stated that Whispering Hills did not seek to prevent consideration of an alternate that would more fully address SDG&E's concerns about the DD.

Blattner asserted that the draft decision sets a dangerous precedent by requiring renegotiation of a price agreed to by two willing parties that was based on an independent appraisal and substantiated in the record of the proceeding. Blattner stated that project opponents' general comparisons of unencumbered property values are not appropriate. Blattner indicated that the renegotiation order could have a chilling effect on Section 851 transactions.
