Carroll stated that the proposed decision (PD) correctly finds Pacific Gas and Electric Company made no record to justify a longer nonbypassable charge exposure period than 10 years. Carroll also noted that there is no finding in the PD that CC8 will benefit POU customers. Carroll indicated that the PD also contains no consideration of the `fair share' doctrine. Peevey, Fong Wan, Vice President, Energy Procurement, and Brian Cherry, Direct, Regulatory Relations, for PG&E, and Marc Joseph, attorney for the Coalition of California Utility Employees (CUE). Jacobson recommended that the proposed decision be modified to adopt a 30-year non-bypassable charge as agreed to in the Settlement between PG&E, The Utility Reform Network, Division of Ratepayer Advocates, and the CUE and California Unions for Reliable Energy. Jacobson stated that it was equitable to recover stranded costs, of any, from the Contra Costa 8 generation facility over the 30-year depreciation life of the asset. Joseph, Wan and Cherry explained the importance and rationale behind a 30-year non-bypassable charge.
