On February 8, 2007, Maria L. Bondonno, counsel for Division of Ratepayer Advocates (DRA), met with Bob Lane, advisor to Cmmr. Bohn in San Francisco. Also present were Danilo Sanchez, DRA Water Manager and Tatiana Olea, Regulatory Analyst for DRA. Olea discussed Butte County's concerns regarding the approval of Del Oro's Mitigated Negative Declaration and Conditional Use Permit in connection with CEQA and the County intends to limit the number of new connections in Del Oro's service territory. Olea indicated that such restrictions could require Del Oro to make change to the engineering design and planning of the project. Bondonno stated that Del Oro may need to amend or refile its application and if Del Oro's application is amended, DRA requests that discovery be reopened and parties be allowed to file revised evidentiary testimony.

On January 26, 2007, Thomas J. MacBride, Jr., counsel for Del Oro Water Company (Del Oro) had a telephone conversation with Robert Lane, advisor to Cmmr. Bohn. MacBride stated that Del Oro expected to receive the requisite approval from Butte County in March of this year. MacBride stated he did not believe that the pending applications before the Commission should be withdrawn and refiled at the conclusion of the Butte County approval process. MacBride added that the decision by the Butte County Planning Commission was not likely to result in any material changes to the applications or the previously filed prepared testimony.
