Written materials (attached to the notice) were used. Pocta stated that Proposed Decision ("PD") was correct in rejecting the Fama French model and in slightly reducing Southern California Edison Company's Return on Equity. Pocta also stated that the PD's conclusion that revenue decoupling increases risk is factual error and explained why revenue decoupling actually serves to reduce business risk. Pocta stated that the record evidence supported the return on equity for each utility as shown in the handout. Contact Person: Sue Muniz; telephone: (415) 703-1858; e-mail: sam@cpuc.ca.gov.

Description: SUMMARY: On November 28, 2007, Mark Pocta, Program Manager for the Division of Ratepayer Advocates (DRA) met with Stephen St. Marie, advisor to Cmmr. Bohn in San Francisco. Also present was Jonathan Bromson, counsel for DRA. DRA noted that the argument of Pacific Gas and Electric Company ("PG&E") that it would be exceeding its rate base forecast of investment for 2008 should not be accorded any weight, as PG&E had agreed to that capital investment forecast in a settlement with DRA of PG&E's 2008 General Rate Case, and thus PG&E had accepted the risk of any additional investment. DRA stated that the text of the Proposed Decision ("PD") stating that revenue decoupling increased risks to utilities was in error, as revenue decoupling decreases risks to utilities. DRA requested that this language be stricken from the final decision, and returns on equity ("ROEs") for the utilities adjusted downward by 20 basis points to reflect this error. DRA further noted that the PD understated the amount it adjusted the ROEs

Description: SUMMARY: On November 30, 2007 Lad Lorenz, Vice President of Regulatory Affairs for San Diego Gas & Electric Company (SDG&E) met with Jaclyn Marks, advisor to Cmmr. Simon in San Francisco. Written materials (attached to the notice) were used. Lorenz indicated that while the framework in the Proposed Decision (PD) to derive the recommended ROE for SDG&E of 11.1% is sound, there is a factual error that, when corrected results in an ROE of 11.4%. Lorenz noted that on the error, the PD then proceeds to make a 30 basis point downward adjustment to SDG&E's recommended ROE and adjusting the outcome to correct the error would result in SDG&E's ROE being set at 11.4%. Description: SUMMARY: On November 30, 2007 Lad Lorenz, Vice President of Regulatory Affairs for San Diego Gas & Electric Company (SDG&E) and Southern California Gas Company (SoCalGas) met with Robert Kinosian, advisor to Cmmr. Bohn in San Francisco. Also present was Lindsay Brown, advisor to Cmmr. Brown. Written materials (attached to the notice) were used. Lorenz indicated that while the framework in the Proposed Decision (PD) to derive the recommended ROE for SDG&E of 11.1% is sound, there is a factual error that, when corrected, results in an ROE for SDG&E of 11.4%. The factual error occurs on page 41 of the PD in reference to Sempra's Energy's credit rating being A plus, when in fact, as evidence in the record acknowledges, Sempra's credit rating is BBB plus, in line with the proxy group. Based on this error, the PD then proceeds to make a 30 basis point downward adjustment to SDG&E's recommended ROE. Adjusting the outcome to correct the error, with no further adjustments to the PD's proposed framework and conclusion

Description: SUMMARY: On November 26, 2007 James Weil, Director for Aglet Consumer Alliance (Aglet) met with Cmmr. Simon in San Francisco. Also present were Jaclyn Marks, Robert Mason, and Marzia Zafar, advisors to Cmmr. Simon; and Hayley Goodson, attorney for The Utility Reform Network. Weil stated that the returns on equity in the November 6 proposed decision in this matter would likely be the highest authorized in the U.S. in 2007. The returns are inconsistent with declining national trends of authorized returns, and with the rating of California regulation among the highest 15 of 50 jurisdictions rated by Regulatory Research Associates. Weil stated that the proposed decision errs by unfairly excluding from consideration the financial model results of Aglet, TURN and Utility Consumers' Action Network (UCAN). Weil stated that the Commission has directed parties to decide which modeling methods suit them and stick to those methods, and Aglet, TURN and UCAN complied with that direction. Description: SUMMARY: On October 15, 2007 Marcel Hawiger, staff attorney with The Utility Reform Network (TURN) orally addressed Cmmr. Bohn during his presentation at the 2007 CPUC Annual Meeting in Monterey, California. Hawiger stated that in TURN's opinion various regulatory mechanisms, such as revenue decoupling, ERRA balancing account treatment for fuel costs, the AB 57 framework for power purchase contracts, and recent applications for pre-approval of major capital expenditures (such as SONGS, Contra Costa 8 and AMI), have eliminated much of the traditional risk for California utilities. Hawiger stated that nevertheless California returns on equity are relatively high, and that all 2007 decisions in other states have adopted utility ROEs below 11.0%.
