On February 11, 2004, Christopher Danforth of the Office of Ratepayer Advocates (ORA), met with Manuel Ramirez, advisor to Cmmr. Wood, in San Francisco. Also present were Steve Linsey and Natalie Walsh, for ORA, and Regina DeAngelis, counsel for the ORA. Written materials (attached to the notice) were used. Walsh expressed ORA's position that no legal authority exists for PG&E's recovery of the electric restructuring costs and that the Commission, accordingly, could dispose of this application expeditiously, and without having to commit its limited staff to assessing the reasonableness of the requested expenses, by first considering the legal basis for the application. Linsey clarified the scope of the threshold legal issue presented by the proceeding as PG&E's right to recover electric restructuring costs as opposed to transition costs. Danforth addressed the extent to which PG&E seeks to recover the same costs in A00-07-013 as PG&E will recover through its Regulatory Asset in I02-04-026.
