Summary: On February 2, 2001, Elaine Duncan, counsel for Verizon California, Inc., participated in a telephone conference with ALJ Thomas. Also present was Laura Tudisco of the Office of Ratepayer Advocates. Referring to the recent decision by the D.C. Circuit Court of Appeals in Association of Communications Enterprises v. Federal Communications Commission (ASCENT v. FCC), No. 99-1441, Duncan explained that, in essence, the D.C. Circuit?s decision called into questions the FCC?s requirement of a structurally separate affiliate for SBC?s provision of advanced services. Duncan noted that the FCC?s Merger Conditions imposed on Verizon provide that the separate data affiliate requirement sunsets under such circumstances, but not until nine months after issuance of a ?final and non-appealable? judicial decision. Duncan explained that the ASCENT v. FCC decision was not yet final and non-appealable.
