Also present were Linda Serizawa and Steve Weissman, advisors to Cmmr. Wood. Cherry stated that the proposed decision (PD), granting PG&E a one-year extension, was an acceptable compromise to PG&E's request for a two-year extension. Cherry stated that the PD should be voted on as soon as possible to reassure gas suppliers that they would continue to have a security interest in gas sales to PG&E.

On February 28, 2002, Brian Cherry, Regulatory Relations of Pacific Gas and Electric Company (PG&E), met with Belinda Gatti, advisor to Cmmr. Brown, in San Francisco. Cherry stated that it was imperative for the Commission to reach a decision before March 15, 2002, because under normal contracting terms and conditions, gas purchases made after that date would not be subject to security guarantees now in place. Cherry also stated that continuance of the security program would assure that core customers were able to purchase competitively price gas supplies.

Cherry indicated the need for expedited approval of PG&E?s application for emergency assistance and petition for modification of D00-12-062. Cherry discussed the precarious nature of PG&E?s current core supply commitments and the participation of supplies under the new secured contracts. Cherry stated that the 90-day limitation imposed by the Commission under the order was preventing PG&E from negotiating forward contracts for seasonal storage and winter 2001/2002 supply arrangements.

Stock and Woo explained that December petitions were separate from the petition filed in January for authorization to use accounts receivables as security for purchases of core gas. Smith indicated that the gas supply situation is still precarious and the DOE order will end on February 7. Smith noted that suppliers are making commitments now for February and continue to be reluctant to enter into any transactions with PG&E without additional credit assurances. Smith explained that failure of PG&E's core procurement to obtain supplies during the current bid-week will make it difficult for them to obtain February supplies at any price next month and that offering a security interest in a portion of PG&E's accounts receivable will be a significant help in obtaining forward gas supplies. Smith stressed that failure to provide this assurance by postponing action will greatly diminish PG&E's ability to acquire supplies for February and beyond. Smith noted that the most important thing is for the Commission to act imm

Description:
On January 12, 2001, Bob Monti, attorney for PG&E Corporation, sent an e-mail (attached to the notice) to ALJ Kenney. In his e-mail, Monti asked that the Commission consider waiving or deferring the fees related to financing decisions pursuant to Public Utilities Code Section 1904(b). Monti explained that these fees would negatively affect Pacific Gas and Electric Company?s (PG&E) financial condition, given its current liquidity problems. Monti also noted that it is very important that PG&E?s pending financing petitions be acted on during the January 18, 2001 Commission meeting.

On the same date, December 6, 2000, Gordon R. Smith, President and Chief Executive Officer, PG&E, had a telephone conversation with Cmmr. Wood and made the same points.
