On March 29, 2004, Michelle Robinson, Vice President Regulatory, Verizon California Inc. (Verizon), spoke with Peter Hanson, advisor to Cmmr. Brown, on the telephone and met with Lester Wong, advisor to Pres. Peevey, in San Francisco. At the meeting with Lester Wong also present was Roosevelt Grant, advisor to Pres. Peevey. Robinson stated that ALJ Thomas' draft decision is a significant departure from existing Commission precedent and has negative implications that are not limited to PG&E. Robinson encouraged the Commission to support Cmmr. Kennedy's alternate, which is consistent with well-established Commission precedent.

O'Neill stated that both the San Francisco and Los Angeles backbone networks have been constructed, with minor modifications approved by the Commission, and that no further construction is currently planned by MFNS. O'Neill stated that if the application is not approved, MFNS will be limited to a license for its facilities installed on Pacific Gas and Electric property, even though the MFNS facilities have been subject to far more thorough, route-specific environmental analysis than most other telecommunications company facilities for which the Commission has approved leases.

O'Neill stated that the proposed decision appears to misconstrue the California Environmental Quality Act (CEQA), Commission practice with respect to licensing and environmental review of telecommunications network facilities, and Commission policy concerning Public Utilities Code section 851. O'Neill stated that CEQA does prohibit segregating a single large project into a number of separate smaller projects, but pointed out that this prohibition does not apply where future customers of a network cannot be determined with any certainty and where the location of possible future network facilities is entirely speculative and not susceptible of meaningful analysis.
