Davies and Day discussed the proposed decision and the alternate and indicated that their review of the legal precedents substantially disagreed with the conclusion in the two decisions. Specifically, Davies and Day indicated that the two decisions relied upon in the PD and alternate were decided after the EnCana merger was final, while the case which held that a similar transaction was not subject to Section 854 was decided prior to the EnCana merger.
