SCE representatives expressed its support for the proposed decision (PD) over the alternate. SCE representatives stated that it was unable and unwilling to acquire Mountainview as a directly-owned asset until the customer base stability and cost recovery issues had been addressed. SCE representatives explained that there were negative consequences to SCE and its customers if Mountainview was not acquired through a Federal Energy Regulatory Commission (FERC)-jurisdictional affiliate. Responding to a concern over FERC making changes to the power purchase agreement, SCE representatives noted that the PD prevents SCE from executing the contract if FERC makes changes that affect rates without getting Commission approval of the changes.

Fogelman noted that undisputed record evidence shows that Mohave is more cost-effective than Mountainview. Fogelman also communicated the Navajo Nation's concern that Southern California Edison Company's (SCE) Mountainview Application would prejudice the future of the Mohave Generating Station. In view of the likelihood that the final decision will be overturned on appeal if the PD remains unchanged, Fogelman recommended that the Commission keep the proceeding open.

Finally, Joseph noted that CUE has a big stake in the continued operation of Mohave, but there is no conflict between keeping Mohave open and approving the Mountainview application.
