Mattes noted WorldCom's commitment to carrying out fully the recommendations for corporate governance of Richard Breeden, the Corporate Monitor appointed by the U.S. District Court of the Southern District of New York, in his report. Observing that enforcement of those recommendations was the responsibility of the U.S. Securities and Exchange Commission and the U.S. District Court, Mattes noted WorldCom's opposition to the draft decision's claim that the recommendations may be enforced by the Commission.

On November 3, 2003, Jose E. Guzman, Jr., counsel to WorldCom, Inc. (WorldCom) sent a letter with one attachment to ALJ Thomas. A copy of the correspondence is attached to the notice. Copies of the correspondence were also sent to Lionel Wilson, Arocles Aguilar, and Joel Perlstein of the Legal Division. The letter transmitted a copy of the October 31, 2003 order of Judge Gonzales of the United States Bankruptcy Court for the Southern District of New York confirming WorldCom's second amended plan of reorganization. In the letter, Guzman stated that WorldCom hoped that the Commission would be able to approve WorldCom's application within the time frame set for the in the September, 2003 stipulation.
