THIS IS AN AUGMENTED NOTICE OF AN EX PARTE COMMUNICATION THAT WAS FILED ON FEBRUARY 3, 2005, AND APPEARED IN THE CALENDAR OF FEBRUARY 7, 2005. On January 31, 2005, 2003, Greg Gierczak, Executive Director - External Relations for SureWest Communications (SureWest), met with Tim Sullivan, advisor to Cmmr. Kennedy, and Lester Wong, advisor to Pres. Peevey, in two separate meetings in San Francisco, and later on the same day of January 31, 2005, Gierczak provided follow-up information to Lester Wong via telephone. Also present was Sean Beatty of Cooper, White & Cooper LLP, counsel to SureWest. A copy (attached to the notice) of Exhibit 201-C from the hearing was used during the meeting with Tim Sullivan. Gierczak explained that the SureWest pole attachment rate identified in the Final Arbitrator's Report was artificially understated, because it assumed that SBC CLEC would attach to every pole in SureWest's service area. Peevey, in San Francisco. Also present were Grace Ferguson, Senior Paralegal, and Paul Walters, outside counsel, for SBC CA. Joint Exhibit 201-C, attached to a motion for leave to file under seal filed concurrently with this notice, was used. SBC CA's representatives explained that the rates set forth in the proposed decision are consistent with the Federal Communications Commission's (FCC) formula used to determine pole rates. In addition, SBC CA's representatives stated that SureWest's proposed pole rates were not consistent with the FCC methodology.
