Description: On May 18, 2005, Cleveland Lee, attorney for the Office of Ratepayer Advocates (ORA), met with Rami Kahlon, advisor to Cmmr. Peevey, in San Francisco. Also present were Ray Charvez and Danilo Sanchez, of the ORA. ORA discussed its view of the issues concerning recovery of the Water Quality Litigation Memorandum Account (Memo Account). The ORA stated that the Master Settlement Agreement and Release (MSAR) and the evidence of record indicate that the Southern California Water Company (SCWC) would rapidly recover the recorded balance of the Memo Account. The ORA stated that the Commission did not guarantee recovery of the Memo Account under Resolution W-4181, which authorized the Memo Account, but SCWC is asking the Commission to have the ratepayers indemnify SCWC against the recovery contingencies in the MSAR that SCWC negotiated for and accepted. The ORA further pointed out that the MSAR reasonably assures recovery of the Memo Account for the purposes of the Financial Accounting Standards.

SCWC then discussed the current status of that regulatory asset, and the need for additional evidence of recoverability through the rate process of the litigation costs and expenses recorded in the memo account.
