On February 22, 2005, Brian Cherry, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), participated in an all-party meeting with Cmmr. Brown in San Francisco. Also present were David Gamson, advisor to Cmmr. Brown, Greg Rueger, Senior Vice President and Chief Nuclear Officer, and Jennifer Post, counsel, for PG&E, and other attendees listed on a sign-in sheet, attached to the notice. Rueger addressed the construction delays that would result by a delayed vote on the interim decision. Rueger stated that any halt in construction contract progress would result in the project slipping at least one cycle, increasing the likelihood that three California nuclear generation units would be off-line at the same time in 2009. Post discussed the Westinghouse litigation, noting that PG&E had no valid cause of action for breach of warranty or fraud.

Also present was Peter Hanson, advisor to Cmmr. Brown. Cherry discussed PG&E's recently filed motion to strike the testimony. Cherry stated that any PG&E response casting doubt on the merits of a claim against Westinghouse used in a Commission proceeding would be used as evidence against a PG&E claim in a civil court, thus leaving PG&E in a no-win situation.

|
Description:
On July 1, 2004, Brian Cherry, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with David Gamson, advisor to Cmmr. Brown, in San Francisco. Also present was Peter Hanson, advisor to Cmmr. Brown. Cherry expressed concerns over the Assigned Commissioner and Assigned ALJ's September 2005 decision date, given that the case would be submitted and essentially complete on all matters except for environmental review by October 2004. Cherry also expressed concerns that such a delay would expose PG&E to a significant investment risk, if the project is rejected.
