Also present were Jasjit Sekhon and Danilo Sanchez of the ORA. ORA discussed the Commission's allocation to ratepayers of the Folsom lease revenue in D04-03-039. ORA opined that the Commission decision was reasonable, consistent with the law, and in the public's interest. ORA noted that after the Southern California Water Company exhausted their administrative remedies, the company has now taken their appeal to the California Supreme Court.

On November 12, 2004, Floyd Wicks, representing Southern California Water Company (SCWC), met with Rami Kahlon, advisor to Cmmr. Peevey, in San Francisco. SCWC representatives discussed the allocation of the past Folsom lease revenues to ratepayers ordered in D04-03-039. SCWC expressed the view that the allocation ordered in that decision was improper and contrary to Commission precedent and policy. SCWC presented its view that the allocation of past revenues as ordered in D04-03-039 should be reexamined in this proceeding and asked the Commission to consider adding the allocation of past lease revenues as an issue within the scope of this proceeding.
