On April 3, 2006, John Hughes, Manager, Southern California Edison Company (SCE), telephoned Stephen St. Marie, advisor to Cmmr. Bohn. Russ Worden, 2006 General Rate Case Manager, SCE, also participated in the conversation. The SCE representatives stated that in the most recent revised proposed decision, the new terms would eliminate the revenue requirement, but apparently allow SCE to record certain expenses in a memorandum account. The SCE representatives stated that actual terms of this memorandum account were unclear and that it may effectively eliminate utility-owned generation which would provide sustained cost-based service to SCE customers. The SCE representatives urged the Commission to explore the issues on this topic. Cragg explained that, in order to ensure a competitive power market, project development costs for utility projects and independent power projects should be treated identically. Cragg explained that although the proposed decision (PD) for the General Rate Case (GRC) of Southern California Edison Company (SCE) embraced that principle, it proposed to include in rates the expenses of SCE's proposed Project Development Department (PDD). Cragg noted that the PD also made the PDD authorization subject to refund, but it is not clear which costs would be refunded and how and when the refund would be accomplished. Cragg suggested that the PD should be revised to be clearer. In addition, Cragg stated that a more direct way to accomplish the same result would be to deny SCE's request, to place shareholders at risk for recovery of project development cost

Joseph indicated that the basic idea of the Stipulation was not to prejudge the amount the Commission would authorize for infrastructure investment, but to ensure that whatever the Commission authorized would not be diverted to other uses. Joseph urged that the Stipulation be adopted by the Commission.

Worden stated that SCE is committed to the capital investment program and stepped-up recruitment, training and retention of employees in the Transmission and Distribution Business Unit. Worden also noted that many assets in SCE's system are reaching the ends of their operating lives and must be replaced or repaired on an accelerated schedule. Worden stated that SCE prefers the terms of the pending stipulation and observed that the pending stipulation will not be unduly burdensome on SCE.

On November 8, 2005, Russell G. Worden, General Rate Case Manager of Southern California Edison Company (SCE), had a telephone conversation with David Gamson, advisor to Cmmr. Brown. Worden discussed SCE's motion for a memorandum account (Motion). Worden stated that no party to SCE's 2006 general rate case had opposed the Motion. Worden stated that if computational errors appeared in a proposed decision, SCE would have to work with the Energy Division and all parties to make the necessary corrections, possibly delaying timely action by the Commission. Worden explained that the memorandum account is simply a step to mitigate the effects of potential delay in reaching a final decision.
