On June 23, 2005, Mona Tierney, Director of Government Affairs of Constellation NewEnergy, Inc., representing the Alliance for Retail Energy Markets, met with Julie Fitch, advisor to Cmmr. Peevey, in San Francisco. Tierney discussed the assigned Commissioner's Ruling dated March 14, 2005. Tierney discussed Southern California Edison's (SCE) proposal to enter into power purchase agreements for up to 1,500 MW of new generation capacity, and its proposal to recover the costs of that new capacity from retail customers, including direct access (DA) customers. Tierney stated that SCE's proposal is wrongheaded and unfair to DA customers, and questioned whether it would be lawful for SCE to recover the costs of new capacity from existing DA customers.
