DiStefano stated that the DD's conclusion that SBC should be allowed in impose additional charges on competitive local exchange carriers when SBC deploys repeaters and multiplexers was based on a misunderstanding of the Commission approach to TELRIC analysis in the UNE relook docket. DiStefano argued that to allow SBC to impose any additional charges for RNMs would violate both TELRIC principles and the Federal Communications Commission's prohibition against double recovery. DiStefano suggested that the Commission should take the time necessary to insure that its RNM decision is consistent with its UNE relook decision. DiStefano explained that deciding the RNM issue correctly was important to Arrival.

DiStefano stated that the DD's conclusion that SBC should be allowed in impose additional charges on competitive local exchange carriers when SBC deploys repeaters and multiplexers was based on a misunderstanding of the Commission approach to TELRIC analysis in the UNE relook docket. DiStefano argued that to allow SBC to impose any additional charges for RNMs would violate both TELRIC principles and the Federal Communications Commission's prohibition against double recovery. DiStefano suggested that the Commission should take the time necessary to insure that its RNM decision is consistent with its UNE relook decision. DiStefano explained that deciding the RNM issue correctly was important to Arrival.
