SUMMARY: On August 29, 2006, Robert Kinosian, Assistant Director of the
Division of Ratepayer Advocates (DRA), met with Laura Krannawitter, advisor to
Cmmr. Bohn, in San Francisco. Also present were Danilo Sanchez, Program
Manager, Ray Charvez, Project Manager, and Selina Shek, counsel, for DRA, and
Kendall H. MacVey, City Attorney for the City of Fontana (City). Copies of the
DRA and the City's Briefs filed in this proceeding were sent to Laura
Krannawitter by electronic mail on August 30, 2006. Charvez discussed the
proposed decision's (PD) appropriate disposition for ratemaking purposes of
proceeds from 'sales' of property under threat of condemnation. MacVey stated
that, in contrast to the PD's conclusions, San Gabriel's record keeping of the
proceeds was inadequate. Charvez emphasized the need for San Gabriel's
Sandhill Treatment Plant to be included in the PD's proposed rate base cap.
MacVey discussed how the only effective application of a facilities fee is to
apply it as a contribution to rate base. MacVey stated the PD correctly
concluded that San Gabriel committed an affiliate transaction with its purchase
of the land and that only $591,250 of the cost of the land should be allowed in
rate base. Shek reiterated the PD's findings that 'dividends were not paid
solely from accumulated net earnings, but were paid from earnings plus funds
