On July 9, 2007, Robert Kinosian, Manager of Division of Ratepayer Advocates (DRA), met with Mathew Deal, advisor to Pres. Peevey in San Francisco. Kinosian informed Deal that the Proposed Decision (PD) contains legal and factual errors. Specifically, the PD erred in concluding that there was no evidence to demonstrate that the current line extension allowance results in an unreasonable subsidy to housing developers and that the PD's proposed method of setting the allowance at 100% of distribution revenues results in a subsidy. Kinosian urged the Commission to reject the PD as it currently stands.

On July 3, 2007, John Clarke, Manager, Regulatory Relations of Pacific Gas and Electric Company (PG&E) met with Mathew Deal, advisor to Pres. Peevey in San Francisco. Also present were Bruce Smith, Manager, Revenue Requirements for PG&E; and Stephen Garber, Attorney for PG&E. Clark stated that PG&E's proposal for revenue recovery was erroneously treated as out of scope in the Proposed Decision. Garber noted the scoping memo ordered PG&E to re-file its application and that PG&E's revenue recovery proposal was not excluded in the scoping memo. Clark explained that a revenue recovery adjustment was not proposed in PG&E's most recent GRC because of regulatory timing gaps, and that revenue deficiency of the magnitude PG&E represented in its Application will necessarily have to be funded from reliability and maintenance programs.
