On March 29, 2006, Richard Clark, Director of the Consumer Protection and Safety Division met with Robert Lane, advisor to Cmmr. Bohn, in San Francisco. Clark voiced his belief that the failure of an Applicant to disclose a past investigation and past sanction, even if inadvertent, constitutes a Rule 1 violation that should be addressed by the Commission. Clark then discussed, as a general matter, whether it is efficient or necessary to open up a separate complaint proceeding when a Rule 1 violation became apparent in the application docket.
