Filed By:
DRA/LEE/CPUC
Description: LATE-FILED. SUMMARY: On October 4, 2007 Victor Chan, the Project Manager for the Division of Ratepayer Advocates (DRA) had a telephone conversation with Hazlyn Fortune, advisor to Cmmr. Grueneich in San Francisco. DRA stated that it supports the Proposed Decision's 10% disallowance of the labor cost for the 19 or more positions requested; and the Alternate's proposal of a $25,000 fine would not effectively deter GSWC, or other Class A water utilities from withholding information until their rebuttal. DRA/LEE/CPUC
Description: SUMMARY: On August 20, 2007 Dana Appling of the Division of Ratepayer Advocates (DRA) met with Cmmr. Bohn in San Francisco. Also present were Laura Krannawitter and Lindsay Brown, advisors to Cmmr. Bohn; Danilo Sanchez, and Cleveland Lee, of DRA. Mehboob Aslam of DRA participated by telephone. DRA stated that GSWC did not provide the justification and data support for the 20 or more positions requested in the General Office except by rebuttal testimony which was 200 or more pages. DRA commented that the Alternate's fine of $25,000 in lieu of the Proposed Decision's (PD) 10% disallowance, would not effectively deter GSWC from similar behavior in future proceedings. DRA further stated that an Order to Show Cause (OSC) and having DRA to file testimony in response to the OSC is unnecessary because the PD already has found the facts of record that support the 10% disallowance and the Alternate's $25,000 fine. DRA urged upholding the PD's 50% allocation between shareholders and the ratepayers of the labor costs as

Golden State Water Company
Description: SUMMARY: On August 14, 2007 Keith Switzer of Golden State Water Company (GSWC) met with Cmmr. Bohn in San Francisco. Also present were, Steve St. Marie, Laura Krannawitter, and Lindsay M. Brown, advisors to Cmmr. Bohn; Michael George, Robert Sprowls, and Patricia Schmiege, attorneys for GSWC. Switzer discussed why GSWC disagreed with the logic in the two proposed decisions for rejecting GSWC's proposed allocation. Switzer reviewed the history of GSWC's prior GRC proceedings on this allocation methodology issue and how the proposed allocation in the Proposed Decision (PD) and the Alternate Proposed Decision (AD) was inconsistent with the directives that the Commission had previously issued. Switzer also discussed the proposed three-factor allocation methodology in the PD and the AD, highlighting some of the assumptions in that method. Contact Person: Patricia Schmiege, telephone: (415) 458-1605, email: pschmiege@schmiegelaw.com.
