SUMMARY: On September 28, 2007 Andrew Ulmer, Chief Counsel for the Division of Ratepayer Advocates (DRA) met with Mathew Deal, advisor to Pres. Peevey in San Francisco. Also present was Edward Moldavsky, attorney for DRA. DRA stated the Commission should move forward with a prehearing conference in A.07-07-025. DRA also stated that it intends to ensure that the Commission has all of the necessary information to determine whether or not the underlying transaction in A.07-07-025 meets the standard set forth in California Public Utilities Code § 854, including whether any conditions should attach to the proposed transaction. DRA noted that it has received assurances from the Joint Applicants that the underlying transaction would not result in a nexus between Wild Goose and Lodi, through the Carlyle/Riverstone entities. McTarnaghan explained that the Protest was based on a misunderstanding by DRA concerning the ownership and control of Buckeye and related companies.
