On June 17, 2003, David L. Wilner, Representative for the Oakland Unified School District, sent an email (attached to the notice) to the assigned ALJ Bushey and on the same date, June 17, 2003, Wilner had two telephone communications with the Chief ALJ Minkin. Copies of the email were also sent to the Chief ALJ Minkin, David Shantz and Katherine Morehouse of the Commission. Wilner expressed concern that the Complainant may not receive a fair hearing in this matter. In the second telephone conversation with the Chief ALJ Minkin, Wilner stated that he decided not to seek a petition for reassignment at this time.
