ORA/TUDISCO/PUC
Description: On December 14, 2005, Dana Appling, Director of the Office of Ratepayer Advocates (ORA), met with Pres. Peevey in San Francisco. Also present were Marc Pocta, Program Manager, and Harvey Morris, Assistant General Counsel, for the ORA. Morris stated that ORA is requesting the Commission adopt the proposed decision of ALJ Halligan. Morris explained that the alternate decision which grants PG&E a rate increase for pension contributions effective January 2006 is inconsistent with the terms of the last general rate case (GRC) settlement and four-year GRC cycle. Pocta expressed the concerns that the alternate adopts PG&E's opinion as the funding status of PG&E's pension trust without allowing other parties to express their views. Pocta noted that the appropriate level of funding is a complex policy matter that should be considered in the GRC. Pocta noted that PG&E has addressed pension funding for 2007-2009 in its current GRC.

Dowdell clarified that funding a 2006 pension contribution in 2006 rates subject to refund would result in lower costs to customers than if the Commission approved contributions for all years as part of the 2007 general rate case.

Also present was Laura Tudisco, Staff Counsel, for the ORA. Tudisco stated that ORA is urging the Commission to adopt the proposed decision of ALJ Halligan and not to adopt the alternate decision which grants Pacific Gas and Electric Company (PG&E) rate increase for pension contributions in violation of basic due process protections. Pocta expressed his concerns that the alternate adopts PG&E's opinions as to the funding status of PG&E's pension trust without allowing other parties to express their views. Pocta and Appling noted that the appropriate level of funding is a complex policy matter that should be considered in the general rate case.

PACIFIC GAS AND ELECTRIC COMPANY
Description: On October 13, 2005, Brian Cherry, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with Pres. Peevey in San Francisco. Also present were Julie Fitch, advisor to Pres. Peevey, and Dan Richard, Senior Vice President, Governmental and Regulatory Relations, PG&E, and Peter Corippo, Director, Investments and Benefit Finance, PG&E Corporation. Cherry discussed PG&E's petition for modification of the 2003 General Rate Case and explained that PG&E was seeking to modify the 2003 GRC to allow PG&E to file an application for a pension showing in 2006. Richard stated that the Commission specifically allowed PG&E to seek this authority in the last GRC due to changed circumstances and that the pension plan would continue to remain below funding levels over the next five years without a contribution.

Description: On October 3, 2005, Brian Cherry, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with Robert Lane, advisor to Cmmr. Bohn, and Aaron Johnson, advisor to Cmmr. Grueneich, in two separate meetings in San Francisco. At the meeting with Robert Lane also present was Stephen St. Marie, advisor to Cmmr. Bohn. Jennifer Dowdell, Manager, Regulatory Relations, PG&E, also attended the meetings. Written materials (attached to the notice) were used. Cherry indicated that unlike its status at the time of the 2003 General Rate Case (GRC) decision, PG&E's pension was currently underfunded and that all PG&E was requesting in its Petition for Modification was an opportunity to make a showing in support of a 2006 pension contribution. Dowdell clarified that to begin pension contributions in 2006 would result in lower costs to customers than if the Commission waited to approve contributions in the 2007 GRC.
