Peevey, and Mike Florio, counsel for TURN. Written materials (attached to the notice) were used. Representatives of TURN explained Cmmr. Bohn Alternate Decision does not fairly address the issues raised by TURN and Aglet and urged support of a revised version of the ALJ Proposed Decision. The representatives stated that the Commission should not encourage utilities to pursue a 'divide and conquer' strategy with intervenors representing the interest of customers. The representative also stated that the Alternate would resolve several key issues in a manner contrary to the decision recently adopted for Southern California Edison.

On December 13, 2006, Matthew Freedman of The Utility Reform Network (TURN), met with Stephen St. Marie, advisor to Cmmr. Bohn, in San Francisco. Also present were Robert Finkelstein and Marcel Hawiger of TURN. Written materials (attached to the notice) were used. Freedman and Finkelstein explained that approval of the settlement presented by Pacific Gas and Electric Company would represent a 'travesty of procedural justice' because of the process by which PG&E chose to pursue settlement negotiations. Freedman and Finkelstein noted that the settlement placed an extremely low value on the litigations positions advocated by TURN and urged the Commission to modify the settlement. Freedman, Finkelstein, and Hawiger reviewed major proposals advocated by TURN that were not incorporated into the final settlement.
