On March 5, 2002, Nettie Hoge of The Utility Reform Network (TURN), met with Cmmr. Kennedy in San Francisco. Also present were Michel Florio, Matthew Freedman, Marcel Hawiger, and Mindy Spatt, for TURN. A chart (attached to the notice) showing the relative rate increases for each customer class was used. Freedman and Florio noted the absence of any residential rate decreases in Southern California Edisons (SCE) application for the establishment of post-PROACT rates. Freedman and Florio urged the Commission to support rate relief for SCEs residential customers proportional to the rate increases they received in 2001 and expressed concerns about the increases that would be experienced by some residential customers under SCEs proposed elimination of tiers 4 and 5. Freedman also expressed concerns that the Commission may require the revenue reductions associated with changes to residential baseline allowances to be added exclusively to the responsibility of the residential class. Freedman argued that this outcome would be unfair in light of the current allocation of undercollections associated with direct access exit fees to all customer classes.

Quadrini added that if the Commission could not implement the rate changes simultaneously with the changes in the baseline quantities, it should do so as quickly as possible in order to avoid rate shock for customers.

Furthermore, Freedman disputed Southern California Edison Company's contention that its federal court settlement with the Commission prohibits the Commission from changing baseline quantities absent a concurrent change in rates to eliminate any temporary revenue shortfall.

Also participating in the conference were Keith Coyne, Team Leader, and Philip Quadrini, Rates Analyst, for PG&E, Paul Kerkporian for the Executive Council Homeowners, and Sean Casey for the Office of Ratepayer Advocates (ORA). Slocum stated that PG&E is drafting a stipulation that will allow an option for affected residential multi-family common area accounts to take service on commercial rates. Slocum stated that since the five-tiered surcharge was implemented, high use common-area customers have been concerned about inordinate increases in their energy bills. Slocum explained that if all common-area accounts were required to switch to commercial rates, the approach would harm the majority of these accounts because most of them have such small energy use and are not currently receiving the residential surcharge. Slocum stated that ORA filed testimony, which PG&E supports, proposing that common-area customers be afforded the option of switching to commercial rate schedules. Slocum also stated that the Commission might consider this stipulation for earlier adoption it if wishes to expedite the resolution of this issue and provide much needed relief to these customers.

Slocum noted that, pursuant to D01-05-064, PG&E implemented a three-sent surcharge by applying a five-tiered surcharge equally to all residential rate schedules. Slocum noted that the five-tier structure, used only to bill the residential surcharge, has affected multi-family building common-area accounts with high monthly use. Slocum stated that prior to a 1992 decision, PG&E's poly-phase service common-area accounts were on commercial rates; however, D92-04-063 ordered PG&E to switch these accounts from commercial to residential schedules. Slocum noted that since the five-tiered surcharge was implemented, many high use-common-area customers have been concerned about increased energy bills. Slocum discussed possible approaches to address this problem.
