Description:
On December 11, 2003, Lee Schavrien, Vice President of Regulatory Affairs, San
Diego Gas & Electric Company (SDG&E) and Southern California Gas Company
(together, the Sempra Energy Utilities (SEU)), met with Ross LaJeuness, advisor
to Cmmr. Kennedy, in San Francisco. Schavrien stated that SDG&E interprets AB
1 to apply to SDG&E's commodity rate. Schavrien explained that the proposed
decision (PD) would move away from cost causation and could increase cost
shifting for ten to twenty years. Schavrien added that conclusions in the PD
about prior rate changes are outside the scope of this proceeding and that
affected customers were not properly noticed that such changes would be
considered.

THIS IS AN AUGMENTED NOTICE OF AN EX PARTE COMMUNICATION THAT WAS FILED ON
March 6, 2003, AND APPEARED IN THE CALENDAR OF March12, 2003. On March 5,
2002, Nettie Hoge of The Utility Reform Network (TURN), met with Cmmr. Kennedy
in San Francisco. Also present were Michel Florio, Matthew Freedman, Marcel
Hawiger, and Mindy Spatt, for TURN. A chart (attached to the notice) showing
the relative rate increases for each customer class was used. Freedman and
Florio noted the absence of any residential rate decreases in Southern
California Edisons (SCE) application for the establishment of post-PROACT
rates. Freedman and Florio urged the Commission to support rate relief for
SCEs residential customers proportional to the rate increases they received in
2001 and expressed concerns about the increases that would be experienced by
some residential customers under SCEs proposed elimination of tiers 4 and 5.
Freedman also expressed concerns that the Commission may require the revenue
reductions associated with changes to residential baseline allowances to be
added exclusively to the responsibility of the residential class. Freedman
argued that this outcome would be unfair in light of the current allocation of
undercollections associated with direct access exit fees to all customer
classes.

Summary: On April 17, 2002, Lee Schavrien, Vice President of Sempra Energy

present were Steven Weissman, advisor to Cmmr. Wood, Aaron Johnson, advisor to
Cmmr. Lynch, Laura Krannawitter, advisor to Cmmr. Duque, Kevin Coughlan and
Julie Fitch, advisors to Cmmr. Peevey, Massis Galestan of the Energy Division;
Billy Blattner, CPUC Relations Administrator for Sempra, and Marie Savage,
Management Advisor, San Diego Gas & Electric Company (SDG&E). Written
materials (attached to the notice) were used. Schavrien described SDG&E?s
revised proposal to split its electric Climate Zone. Schavrien stated that the
revised proposal differs from the previous SDG&E climate zone proposal that was
to follow the exact California Energy Commission climate zones lines which
would cut through heavily populated neighborhoods in the southern half of San
Diego County. Schavrien explained that the proposal would put an estimated 57%
of current Zone 1 customers in the new Coastal Zone with a baseline allowance
of approximately 309 kWh and 43% in the new Inland Zone with a baseline of 359
kWh.

On April 8, 2002, Brian Cherry, Chief of Regulatory Relations for Pacific Gas
and Electric Company (PG&E), met with David Gamson, advisor to Cmmr. Brown, in
San Francisco. Cherry stated that certain modifications should be made to
clarify the Commission's intent for updating the data in 2002. Cherry also
stated that it would be much simpler and administratively efficient if the gas
quantities were updated along with the electric quantities, including a
simultaneous revenue neutral gas adjustment.

Lynne McGhee, advisor to Cmmr. Duque; Massis Galestan of the Energy Division;
and Rodney Winter, Regulatory Affairs Case Administrator, and Marie Savage,
Management Advisor, for San Diego Gas & Electric Company (SDG&E). Written
materials (attached to the notice) were used. Blattner explained that SDG&E
proposed splitting its Climate Zone 1 along the lines used by the California
Energy Commission (CEC). Savage noted the difficulty in assigning customers to
zones suing the CEC lines. Winter suggested that a more refined proposal be
considered in Phase II and that changes in baseline allowances, climate zones
and rates should be concurrent.

Brown. Blattner discussed the ALJ's proposed decision and expressed Sempra's
concern that making changes to baseline allowances without concurrent changes
in rates will result in rate instability. Blattner suggested that changes in
baseline allowances be made in other open proceedings or in Phase II of this
proceeding. Blattner added that concurrent changes in allowances and rates
would avoid undercollections and obviate the need for a balancing account.

On March 19, 2002, Sabrina Chaw, Senior Regulatory Representative of Regulatory
Relations for Pacific Gas and Electric Company (PG&E), attended an all-party
meeting with Cmmr. Wood in San Francisco. Also present were Phil Quadrini,
Senior Rates Analyst, Rate Department, and Bill Stock, Chief, Regulatory
Relations, for PG&E; and other attendees listed on the sign-in sheet attached
to the notice. Chaw asked the Commission to implement baseline quantities
changes concurrently with the corresponding rate changes so that a revenue
shortfall would not occur for the utilities. Chaw emphasized that a balancing
account is not sufficient to establish a pattern of regulatory certainty to the
investment community. Chaw stated that PG&E could implement both the baseline
quantities change and the corresponding rate changes by May 1, 2002. Chaw
explained that if the Commission does not request an implementation date of May
1, 2002, PG&E asks that the Commission consider the timing of when PG&E will
install its new customer information system. Quadrini added that if the
Commission could not implement the rate changes simultaneously with the changes
in the baseline quantities, it should do so as quickly as possible in order to
avoid rate shock for customers.

AUGMENTATION REQUIRED. On March 17, 2002, Matthew Freedman, attorney for The

and Brown in San Francisco. Also present were Lynn McGhee, advisor to Cmmr.
Duque, Kevin Coughlan and Julie Fitch, advisors to Cmmr. Peevey, Aaron Johnson,
advisor to Cmmr. Lynch, and representatives from all the major California
utilities. Freedman urged the Commission to adopt the proposed decision with
certain modifications. Freedman stated that the primary modification involves
excluding the use of 2001 data from the updating of residential baseline
allowances. Freedman also urged the Commission to set the baselines at the
maximum amount permitted by statute. Furthermore, Freedman disputed Southern
California Edison Company's contention that its federal court settlement with
the Commission prohibits the Commission from changing baseline quantities
absent a concurrent change in rates to eliminate any temporary revenue
shortfall.

Quadrini, Rates Analyst, for PG&E, Paul Kerkporian for the Executive Council
Homeowners, and Sean Casey for the Office of Ratepayer Advocates (ORA). Slocum
stated that PG&E is drafting a stipulation that will allow an option for
affected residential multi-family common area accounts to take service on
commercial rates. Slocum stated that since the five-tiered surcharge was
implemented, high use common-area customers have been concerned about
inordinate increases in their energy bills. Slocum explained that if all
common-area accounts were required to switch to commercial rates, the approach
would harm the majority of these accounts because most of them have such small
energy use and are not currently receiving the residential surcharge. Slocum
stated that ORA filed testimony, which PG&E supports, proposing that
common-area customers be afforded the option of switching to commercial rate
schedules. Slocum also stated that the Commission might consider this
stipulation for earlier adoption it if wishes to expedite the resolution of
this issue and provide much needed relief to these customers.

PACIFIC GAS AND ELECTRIC COMPANY
|
|
Description:
On December 18, 2001, Sabrina Chaw, Senior Regulatory Representative of Pacific
Gas and Electric Company (PG&E), met with David Gamson, advisor to Cmmr. Brown,
in San Francisco. Also present were Gail Slocum, Attorney, Keith Coyne, Team
Leader, and Phil Quadrini, Senior Rates Analyst, PG&E. Written material
(attached to the notice) was used. Slocum noted that, pursuant to D01-05-064,
PG&E implemented a three-sent surcharge by applying a five-tiered surcharge
equally to all residential rate schedules. Slocum noted that the five-tier
structure, used only to bill the residential surcharge, has affected
multi-family building common-area accounts with high monthly use. Slocum
stated that prior to a 1992 decision, PG&E's poly-phase service common-area
accounts were on commercial rates; however, D92-04-063 ordered PG&E to switch
these accounts from commercial to residential schedules. Slocum noted that
since the five-tiered surcharge was implemented, many high use-common-area
customers have been concerned about increased energy bills. Slocum discussed
possible approaches to address this problem.
