Setting CLEC switched access charges at Verizon's rate would mean that Verizon
and all CLECs would be allowed to offer switched access at rates three times
higher than the rate offered by AT&T California. The Commission should adopt a
cap on CLEC switched access rates like that imposed by the FCC on CLEC switched
access rates to prevent CLECs from charging excessive rates. In CLEC territory
served by Verizon, the cap would be Verizon's switched access rate, and in CLEC
territory served by AT&T California the cap would be AT&T California's switched

Telscape explained that because CLECs utilize transport network elements that
are different from those used by ILECs, requiring CLECs to mirror ILECs's
access charges would not permit CLECs to recover their transport network costs
even though CLECs provide the same functionality to interexchange carriers as
ILECs. Telscape recommended that, if the Commission continues to find it
necessary to cap CLECs' access charges based on ILEC rates, CLECs should be
permitted to charge functionally equivalent amounts for functionally equivalent
services. Telscape indicated that Verizon's rates are far more appropriate than
AT&T's rates to use as a base because AT&T's rates were arbitrarily reduced
several years ago by a substantial amount in order to offset CHCF-B funding
and, therefore, bear less of a relation to cost than Verizon's rates. Contact
