This decision denies Pacific Bell's (Pacific) petition to modify D96-12-086 in which Pacific sought the following: (1) consideration of an overlay for every new area code implemented prior to the year 2001; and (2) adoption of a policy that favors the implementation of an overlay for most new area codes.

This decision modifies D01-01-062 and D01-02-050 to extend PG&E's authority to pledge its gas customer accounts receivable and core gas inventory for the purpose of procuring core gas supplies.

C00-08-035 - The Utility Reform Network (TURN), the California Mobile Home Resource and Action Association (CMHRAA), and Does 1-100 vs. Four Seasons Mobile Home Park, The Franciscan Mobile Country Club, Rancho Santa Teresa Mobile Home Estates, Diablo Mobile Lodge, Friendly Village Mobile Home Park, Pepper Tree Estates Mobile Home Park, Spanish Ranch Mobile Home Park Number 1, Riverbend Mobilehome Park, Hilton Mobile Home Park, Hillview Mobile Home Park, and Does 1-100.
This decision approves a settlement between TURN and the California Mobile Home Resource and Action Association (CMHRAA) and the ten defendant mobile home parks. The complainants charged that defendants were not in compliance with Public Utilities Code Section 739.5, which prohibits gas master meter customers from retaining natural gas rebates they receive from a gas utility. Parties arrived at a settlement once TURN and CMHRAA were satisfied that defendant mobile home parks had disbursed all of the gas rebates to their sub-metered customers. This proceeding is closed.

I97-07-018 - Order Instituting Investigation (OII) on the Commission's own motion into the operations, practices, rates and charges of the Hillview Water Company, Inc. (Hillview), a corporation, and Roger L. Forrester, the principal shareholder and president.
This interim decision addresses the Motion for Adoption of Settlement (Motion) jointly filed on November 22, 1999, by the Ratepayer Representation Branch (RRB) of the Water Division, and Hillview, one of the respondents in this investigation. The motion asks to adopt a written settlement agreement, executed as of the same date by RRB and Hillview, as "a complete resolution of all issues in the present proceedings." The Motion is denied. This interim decision also addresses Hillview's Petition to Modify Order, filed September 20, 2000, which asks the Commission to modify the OII, dated July 16, 1997, the order that initiated this proceeding. Hillview asks the Commission to delete from the OII a requirement that any proposals to increase rates or charges submitted to the Commission on behalf of Hillview be consolidated with this enforcement proceeding for consideration. The petition is denied.

This decision considers three contested settlement proposals addressing the promising options raised in D99-07-015 as applied to the Southern California Gas Company natural gas system, and to a lesser extent, the San Diego Gas & Electric Company gas system. Based on the record developed regarding costs and benefits, and the official notice we take of gas prices at the border and at Pacific Gas and Electric Company's citygate in the past few months since the close of the evidentiary hearing, we choose to approve the most modest proposal, the Interim Settlement, with some modifications. The major modification is the rejection of the provision for an automatic expansion of capacity at Wheeler Ridge with rolled-in rates if certain criteria are met. Additionally, based on the evidence in the record, we unbundle core interstate transportation from rates, eliminate core contribution to noncore interstate transition cost surcharges and the core subscription option as well as the caps and thresholds for core aggregation programs. We reduce the core aggregation program threshold, and offer billing options to core aggregators. Finally, we once again urge the Legislature to enact consumer protection legislation for those ratepayers served by core aggregators and other marketers. This proceeding is closed.

This decision differs from the Presiding Officer's Decision in the following ways: it determines that Pacific Bell's (Pacific) practice of requiring service representatives to promote optional services on every incoming call violates applicable disclosure and service standards contained in Section 451, Section 2896, and Tariff Rule 12. Like the Presiding Officer's Decision, this decision declines to adjudicate claims that Pacific violated the California Unfair Competition Law (Business and Professions Code Section 17200 et seq. and Section 17500 et seq.), and notes that remedies available under that law are cumulative and in addition to remedies that may be imposed under other laws. The discussion has been revised, however, to clarify that a court is the appropriate forum in which to adjudicate Unfair Competition Law claims and that nothing in this decision is intended to preclude a court from imposing additional remedies under that law. The amount of the fine is not changed significantly ($43.8 Million), but the decision clarifies how the fine amount was calculated and the criteria that were considered. The fine is imposed in its entirety with no portion suspended.

A96-10-038 - Pacific Enterprises, Enova Corporation, Mineral Energy Company, B Mineral Energy Sub and G Mineral Energy Sub.
For approval of a plan of merger of Pacific Enterprises and Enova Corporation with and into B Energy Sub, and G Energy Sub, the wholly-owned subsidiaries of a newly created holding company, Mineral Energy Company. This decision grants the petition of Sempra Energy to modify D98-03-073, the decision which approved the merger of Southern California Gas Company and San Diego Gas and Electric Company. The petition requests authority to merge some management functions of the two utilities to generate further cost savings. Service reliability, service quality, and cost savings are expected from the further consolidation of management functions. This proceeding is closed.

D00-04-060. This decision establishes a cost-based peaking tariff for customers in SoCalGas territory. This tariff will apply to customers who bypass SoCalGas's transmission and distribution system by using an interstate pipeline for baseload requirements, but need SoCalGas for peakload service.

R00-10-002 - Order Instituting Rulemaking into the operation of interruptible load programs offered by Pacific Gas & Electric Company, San Diego Gas & Electric Company, and Southern California Edison Company and the effect of these programs on energy prices, other demand responsiveness programs, and the reliability of the electric system. This decision amends the Priority System for Rotating Outages by adding Category N to the list of essential customers normally excluded from rotating outages. Category N is petroleum refineries, ancillary facilities, and pipelines carrying refined petroleum products to airports when the pipeline is on a firm electricity service schedule. It also includes other customers in the critical fuels chain of production to protect public health and safety, to the extent authorized by the Commission. Backup generation shall not be considered at this time in determining eligibility of a refinery, ancillary facility or pipeline for Category N.

R00-02-004 - Order Instituting Rulemaking on the Commission's Own Motion to Establish Consumer Rights and Consumer Protection Rules Applicable to All Telecommunications Utilities.
This decision adopts interim rules governing non-communications related charges presented in telephone bills. The new rules apply to: (1) any telephone corporation, as defined in Public Utilities Code Section 234, operating in California, whether providing landline or wireless telephone service, that chooses to open its telephone billing service to non-communications-related products and services; (2) any billing agent that presents such charges to a California telephone corporation on behalf of another entity; and (3) any vendor of non-communications-related products or services that bills for those products or services on a California subscriber's telephone bill, whether the vendor makes billing arrangements directly with the California billing telephone company or indirectly through billing agents. The new rules take effect July 1, 2001, the effective date of amendments to Public Utilities Code Section 2890 permitting telephone bills to include charges for non-telecommunications related products and services. R00-02-004 remains open in anticipation of further order(s) promulgating additional consumer protection rules.

R98-07-038 - Rulemaking for purposes of revising General Order 96-A regarding informal filings at the Commission. This interim decision adopts certain rules from the pending General Order (GO) 96-B while deferring action on the rest of the proposals for that GO. Among the main features of the adopted rules, large utilities must publish their tariffs on the Internet by January 1, 2002, and must ensure that any advertising regarding their tariffed service is consistent with the applicable tariffs.

A01-04-007 - Southern California Gas Company (SoCalGas)
For authority to sell cushion gas in its Aliso Canyon and La Goleta Storage Fields. This decision authorizes SoCalGas under Public Utilities Code Section 851 to perform the activities necessary to allow SoCalGas to reclassify 14 billion cubic feet of cushion gas at its Aliso Canyon and La Goleta storage field as working gas available for sale. SoCalGas is prohibited from selling the reclassified cushion gas until further order of the Commission.

A00-10-045 - San Diego Gas & Electric Company (SDG&E).
For authority to implement Assembly Bill 265. A01-01-044 - Related Matter. This decision authorizes rate increases applicable to electric customers of SDG&E in accordance with Assembly Bill X1 1. The increases will provide revenues to fund the California Department of Water Resources' (DWR) procurement of electric power on behalf of SDG&E's retail end use customers. DWR has determined that it requires revenues of $914.9 million for electricity provided to SDG&E's electric customers for the period July 1, 2001 through June 30, 2002. This decision establishes rate increases totaling approximately $503 million, or approximately 3 cents per kWh, to provide sufficient revenues for the collection of the total DWR revenue requirement. Because the total amount of the rate increase is dedicated to DWR, this decision does not change the revenues received by SDG&E for the power that it provides with its retained generation resources. Residential customers whose consumption does not exceed 130% of baseline quantities, CARE customers, and medical baseline customers are exempted from the increases.

- Disposition of the application of Roseville Telephone Company for rehearing of D01-02-042 in which the Commission granted the application of Covad Communication Company (Covad) for rehearing of D00-06-080. At issue are prices Roseville may charge to competing carriers for access to its unbundled network elements (UNEs), in particular the price Roseville may charge Covad for access to the local loop to provide competitive digital service line services to customers in Roseville's territory. In granting Covad's rehearing application, the Commission vacated the previously adopted local loop price of $25.62 as having been derived from a cost study that violates statutory and regulatory rules. The Commission adopted instead a proxy for interim Roseville UNE prices, which are subject to true up upon determination of Roseville's final prices based on TELRIC. The proxy selected is PG&E's deaveraged local loop price of $13.51 for the region near Sacramento and Roseville's service territory. Roseville now seeks rehearing and asks that the $25.62 price be restored.

D01-03-081 further determines the methodology to calculate amounts owed by the utilities to DWR pursuant to Water Code Section 200 and orders the utilities to pay DWR the amounts owed on the day following the effective date of D01-03-081.
