Also present were Audra Hartmann representing Dynegy and Brian Cragg, counsel for SBRP. Johnson and Hartmann described the current status of the new South Bay plant and the efforts to provide increased in-area generation to meet the needs of San Diego Gas & Electric Company and to make sure that the contribution of in-area generation was adequately valued in the analyses of the proposed Sunrise Powerlink.

Summary: On April 6, 2007, Brian Cragg, counsel for Long Beach Generation, LLC (LBG) met with Nancy Ryan, advisor to Pres. Peevey, in San Francisco. Cragg stated that LBG is undertaking extraordinary efforts to keep the Long Beach generation project on track to come online by August 1, and that the permitting processes are moving forward as expected. Cragg underscored that LBG would like a prompt ruling on the applications for rehearing so that the uncertainty created by the appeals can be resolved as quickly as possible.

R06-02-012 - Order Instituting Rulemaking to develop additional methods to implement the California renewables portfolio standard program.

Summary: On April 9, 2007, Stacy Aguayo of APS Energy Services, representing Alliance for Retail Energy Markets (AReM) met with Pres. Peevey in Los Angeles. Also present were Nancy Ryan and Andrew Schwartz, advisors to Pres. Peevey; and Jennifer Chamberlin of Strategic Energy, Greg Kosier of Constellation NewEnergy, representing AReM and Gregory Klatt of Douglass & Liddell, counsel for AReM. The subject of the meeting was the Proposed Decision (PD) of ALJ Simon dated March 30, 2007. AReM representatives stated that they believe the basic requirement of 0.25% of prior year's sales adopted in the PD is not unreasonable, but voiced uncertainty and concern about how non-utility electric service providers would comply with the proposed requirement. The representatives made recommendations to modify the PD and voiced concern about the apparent penalty for non-compliance provided for in the PD.
