CPUC OPENS TWO PENALTY CONSIDERATION CASES
INVOLVING PG&E
SAN FRANCISCO, June 10, 2011 - The California Public Utilities Commission (CPUC) today said it has opened two penalty consideration cases against Pacific Gas and Electric Company (PG&E) for alleged violations of CPUC rules.
In the first case, CPUC staff alleges that PG&E failed to comply with certain environmental mitigation measures in its construction of the Seventh Standard Substation Project. CPUC staff alleges that PG&E did not complete required surveys during specific time windows, did not obtain environmental awareness training for all laborers, and did not notify the CPUC prior to construction in order for the CPUC's environmental monitors to ensure project compliance with the California Environmental Quality Act.

The second penalty consideration case that the CPUC opened yesterday concerns CPUC staff allegations that PG&E violated the CPUC's Resource Adequacy requirement program rules by failing to satisfy its procurement obligations for March, April, and July 2010.
The CPUC's Resource Adequacy program ensures that sufficient resources are available to ensure the safe and reliable operation of the grid in real time.

For both proceedings, CPUC staff and PG&E will present their cases to an Administrative Law Judge who will then prepare Proposed Decisions for Commissioner consideration in determining whether any fines or penalties are warranted.
