ADMINISTRATIVE LAW JUDGE'S RULING

ESTABLISHING SCHEDULE TO REPLY
TO RESPONSES ON PETITION TO MODIFY DECISION 96-12-028

OF SOUTHERN CALIFORNIA EDISON COMPANY

AND TO ADDRESS THE VALIDITY OF BORDER INDICES

On July 28, 2000, Southern California Edison Company (SCE) filed a petition to modify Decision 96-12-028. SCE proposes to modify the Factor in the Transition Formula in order to respond to changing differentials between the border price of natural gas and burner tip prices. Comments were filed on August 28, 2000. In comments, the Office of Ratepayer Advocates (ORA) raises the question of whether the border price indices, especially the Topock border price, used in the Transition Formula remain valid. I believe that this question is relevant to the issue of whether, and if so, how, to modify the Transition Formula and should be addressed by the Commission when it rules on the petition to modify.

Therefore, replies to the responses to SCE's petition should be filed on September 22, 2000. Specifically, parties should comment on the reliability and validity of the current border indices for the Transition Formula for SCE, Pacific Gas and Electric Company (PG&E), and San Diego Gas & Electric Company (SDG&E) given the pricing issues identified in ORA's response. Parties arguing in favor of the use of alternative indices should include quantitative analysis in support of their position. PG&E and SDG&E are directed to address whether the pricing issues identified in SCE's petition and by ORA's response, are affecting the results of their Transition Formula. An additional round of responsive comments to the replies will be allowed on October 10, 2000.

IT IS RULED that:

1. Replies to the responses to Southern California Edison Company's (SCE) petition shall be filed on September 22, 2000. An additional round of responsive comments to the replies shall be filed on October 10, 2000

2. Pacific Gas and Electric Company and San Diego Gas & Electric Company are directed to address whether the pricing issues identified in SCE's petition and by the Office of Ratepayer Advocates' response, are affecting the results of their Transition Formula.

3. Service shall be made by e-mail and hard copy to the service list of Rulemaking 99-11-022.
