ADMINISTRATIVE LAW JUDGE'S RULING
SCHEDULING WORKSHOP TO DISCUSS

PROPOSED DECISION ON PHASE II ISSUES

This ruling schedules a workshop for November 22, 2005 in this proceeding to discuss the proposed decision of the Administrative Law Judge issued November 2, 2005. The purpose of the workshop is to address potential technical errors, internal inconsistencies and proposed program elements or procedures that would be impossible to effect. The workshop will not be a forum for oral argument, or advocacy of parties' positions on policy, law or ratemaking. Parties who attempt to use the workshop for the purpose of advocacy would impose on the time and resources of other parties and compromise procedural fairness.

The format of the workshop will be simple. The ALJ and technical staff will hear parties' concerns about the proposed decision beginning with the first section of the proposed decision and addressing each subsequent session in turn. Any party who wishes to identify infirmities in the proposed decision in advance of the workshop should submit a written list to all parties electronically no later than November 17, 2005. Elements of a party's list that address policy, ratemaking or legal positions will be ignored by the Commission and will not be addressed in the workshop. The workshop will not be reported or otherwise recorded. The Commission may use what it learns from the workshop to inform changes to the proposed decision as long as the changes are consistent with the record of the proceeding.

IT IS RULED that the Commission will conduct a workshop in this proceeding as described herein beginning at 10:00 a.m. on November 22, 2005 in its Courtroom, State Office Building, 505 Van Ness Avenue, San Francisco, California.
