ADMINISTRATIVE LAW JUDGE'S RULING REQUESTING COMMENT
ON STAFF PROPOSAL FOR PERFORMANCE BASED INCENTIVES
AND OTHER ELEMENTS OF THE CALIFORNIA SOLAR INITIATIVE

In Decision (D.) 06-01-024, the Commission created the California Solar Initiative (CSI) and committed to providing $2.8 billion in incentives toward solar development starting in 2006 through 2016. In Rulemaking (R.) 06-03-004, the Commission continues its work from earlier rulemakings to develop program rules and policies to accomplish its goals. When the Commission opened the above-captioned rulemaking, it specifically stated its intent to develop a detailed record on several unresolved CSI program issues over the course of the rulemaking.

By this ruling, I circulate to parties a proposal of the Commission's Energy Division staff, developed in consultation with staff of the California Energy Commission, which addresses the following issues:

Parties are requested to comment on the proposal, including any specific questions posed in the proposal document. Energy Division staff will be available to answer questions regarding the proposal at a workshop on May 4, 2006. The workshop is not a forum to debate ideas or to propose alternate approaches. Parties should reserve such input for written comments. The workshop will be held from 9:30 a.m. to 5:00 p.m. at the Hiram W. Johnson State Office Building, San Diego Rooms A/B/C, 455 Golden Gate Avenue, San Francisco, California.

Therefore, IT IS RULED that:

1. Parties may file comments on the Energy Division staff proposal attached to this ruling no later than May 15, 2006.

2. Parties may file reply comments no later than May 26, 2006.
