ADMINISTRATIVE LAW JUDGE'S RULING
REGARDING SCHEDULE

A preliminary schedule was adopted in the Assigned Commissioner's Ruling Granting Motion for Continuance Plus First Scoping Memo and Ruling of Assigned Commissioner dated November 17, 2003. That schedule included several events that have been calendared, including a second prehearing conference (PHC) on March 3, 2004. (First Scoping Memo and Ruling, Ordering Paragraph 4.)

The preliminary schedule, however, was predicated upon the Commission adopting a decision in the gas industry restructuring (GIR) proceeding (Application 03-06-040) at its meeting on January 22, 2004. The Commission did not adopt such decision at that meeting. The proposed decision and an alternate are on the agenda for the Commission meeting on February 26, 2004, and a decision may or may not be adopted by the Commission at that time.

As a result, the calendared events will be taken off calendar. Pursuant to the November 17, 2003 Ruling, applicants shall file and serve amended applications within 21 and 28 days of the date the GIR decision is mailed. (First Scoping Memo and Ruling, Ordering Paragraph 2.) A Notice of PHC will be filed and served to set the time and date for the second PHC once the GIR decision is adopted by the Commission.

IT IS RULED that the calendared events are taken off calendar.
