Order Instituting Rulemaking to Develop Additional Methods to Implement the California Renewables Portfolio Standard Program.

ADMINISTRATIVE LAW JUDGE'S RULING

ON FILING AND SERVICE OF DOCUMENTS

The order instituting rulemaking in this proceeding notes that this proceeding will have primary responsibility for developing the rules for renewables portfolio standard (RPS) participation of energy service providers (ESPs), community choice aggregators (CCAs), small utilities, and multi-jurisdictional utilities. It will also be closely related to Rulemaking (R.) 04-04-026 and its successor, the proceeding for Commission oversight and administration of the RPS program.

In accordance with prior rulings, the Alliance for Retail Energy Markets, the City of Chula Vista and the City and County of San Francisco, Mountain Utilities, PacifiCorp, and Sierra Pacific Power filed proposals for participation in the RPS program in R.04-04-026. These documents should be made part of the record in R.06-02-012, which is the proceeding in which they will be considered. Comments and responses to these proposals should be filed and served in R.06-02-012, rather than R.04-04-026. Parties should use the service list for R.04-04-026, plus the list of additional respondents attached to R.06-02-012, for service until an updated service list for R.06-02-012 is posted on the Commission's website.

IT IS RULED that:

1. The proposals for renewables portfolio standard's (RPS) participation filed in Rulemaking (R.) 04-04-026 by the Alliance for Retail Energy Markets, the City of Chula Vista and the City and County of San Francisco, Mountain Utilities, PacifiCorp, and Sierra Pacific Power are made part of the record in R.06-02-012.

2. Comments and responses to the above proposals for participation shall be filed in R.06-02-012.

3. Parties shall use the service list for R.04-04-026, with the addition of the respondents listed in the appendices in R.06-02-012, as the service list for R.06-02-012 until a more updated service list is posted on the Commission's website, www.cpuc.ca.gov.
