ORA/TUDISCO/PUC
Description: On December 14, 2005, Dana Appling, Director of the Office of Ratepayer Advocates (ORA), met with Pres. Peevey in San Francisco. Also present were Marc Pocta, Program Manager, and Harvey Morris, Assistant General Counsel, for the ORA. Morris stated that ORA is requesting the Commission adopt the proposed decision of ALJ Halligan. Morris explained that the alternate decision which grants PG&E a rate increase for pension contributions effective January 2006 is inconsistent with the terms of the last general rate case (GRC) settlement and four-year GRC cycle. Pocta expressed the concerns that the alternate adopts PG&E's opinion as the funding status of PG&E's pension trust without allowing other parties to express their views. Pocta noted that the appropriate level of funding is a complex policy matter that should be considered in the GRC. Pocta noted that PG&E has addressed pension funding for 2007-2009 in its current GRC.

Description: On December 12, 2005, Jennifer Dowdell, Chief, Regulatory Relations, Pacific Gas and Electric Company, had a telephone conversation with David Gamson, advisor to Cmmr. Brown. Dowdell clarified that funding a 2006 pension contribution in 2006 rates subject to refund would result in lower costs to customers than if the Commission approved contributions for all years as part of the 2007 general rate case.

Tudisco stated that ORA is urging the Commission to adopt the proposed decision of ALJ Halligan and not to adopt the alternate decision which grants Pacific Gas and Electric Company (PG&E) rate increase for pension contributions in violation of basic due process protections. Pocta expressed his concerns that the alternate adopts PG&E's opinions as to the funding status of PG&E's pension trust without allowing other parties to express their views. Pocta and Appling noted that the appropriate level of funding is a complex policy matter that should be considered in the general rate case.

Description: On October 13, 2005, Brian Cherry, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with Pres. Peevey in San Francisco. Also present were Julie Fitch, advisor to Pres. Peevey, and Dan Richard, Senior Vice President, Governmental and Regulatory Relations, PG&E, and Peter Corippo, Director, Investments and Benefit Finance, PG&E Corporation. Cherry discussed PG&E's petition for modification of the 2003 General Rate Case and explained that PG&E was seeking to modify the 2003 GRC to allow PG&E to file an application for a pension showing in 2006. Richard stated that the Commission specifically allowed PG&E to seek this authority in the last GRC due to changed circumstances and that the pension plan would continue to remain below funding levels over the next five years without a contribution.

Description: On October 3, 2005, Brian Cherry, Director, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with Robert Lane, advisor to Cmmr. Bohn, and Aaron Johnson, advisor to Cmmr. Grueneich, in two separate meetings in San Francisco. At the meeting with Robert Lane also present was Stephen St. Marie, advisor to Cmmr. Bohn. Jennifer Dowdell, Manager, Regulatory Relations, PG&E, also attended the meetings. Written materials (attached to the notice) were used. Cherry indicated that unlike its status at the time of the 2003 General Rate Case (GRC) decision, PG&E's pension was currently underfunded and that all PG&E was requesting in its Petition for Modification was an opportunity to make a showing in support of a 2006 pension contribution. Dowdell clarified that to begin pension contributions in 2006 would result in lower costs to customers than if the Commission waited to approve contributions in the 2007 GRC.

Pocta stated that if the Commission intent is on adopting an incentive mechanism, he recommended that the mechanism be modified to incorporate more modest System Average Interruption Duration Index and System Average Interruption Frequency Index rewards and penalties totaling $24 million, as originally proposed by PG&E.

Also present was Raminder Kahlon, advisor to Pres. Peevey. Pocta urged the adoption of the proposed decision of ALJ Halligan. Pocta explained that ORA was especially concerned with the magnitude of the potential penalties and rewards of $41.6 million in the alternate proposed decisions (APDs) of both Cmmr. Wood and Cmmr. Kennedy. Pocta stated that if the Commission intends to adopt an incentive mechanism, ORA recommends that the mechanism be modified to incorporate more modest System Average Interruption Duration Index and System Average Interruption Frequency Index rewards and penalties totaling $24 million, as originally proposed by Pacific Gas and Electric Company, rather than $41.6 million the APDs would adopt.

Also present were David Gamson and Peter Hanson, advisors to Cmmr. Brown, and Bill Blastic, Director, Electric Control Center, PG&E. Written material (copy attached to the notice) was used. Jacobson stated that PG&E recommends that the Commission adopt the reliability incentive mechanism agreed to by PG&E and CUE. Jacobson indicated that in the event that the Commission does not provide PG&E with the incremental revenues necessary to achieve the reliability benchmarks in the PG&E/CUE joint agreement, the benchmarks should be revised. Jacobson explained the importance of having a deadband large enough to account for performance variations due to weather. Blastic stated that reliability performance statistics are not comparable across utilities. Blastic compared and contrasted alternative incentive mechanisms.

Weil indicated that Aglet took a lead role in litigation of attrition issues. Weil noted that Aglet estimates that the two settlements will save ratepayers approximately $213 million during the years 2004, 2005 and 2006. Weil stated that the settlements are compromises of strongly held views. Weil explained that reliance on the Consumer Price Index rather than utility-specific escalation rates to calculate attrition allowances will benefit ratepayers.

Jordan stated that PG&E supports the California Coalition of Utility Employees/PG&E agreement (Agreement) that is based on a careful balancing of the reliability targets, dead bands, live bands, reward/penalty limits and the incremental revenue requirement. Jordan explained the difference between the 'adequate service' standard and the more stringent reliability targets in the Agreement. Jacobson stated that anticipated reliability improvements would be small compared to the annual fluctuations in SAIDI and SAIFI indices. Pocta stated that ORA supported the proposed decision (PD) of ALJ in PG&E 2003 General Rate Case except with respect to the elimination of the floors for attrition. Pocta indicated that ORA supported the PD's treatment of the pension contribution issue. ORA recommended that the PD be revised to adopt the attrition mechanism floors as set forth in the settlement. Pocta explained that the PD's elimination of the attrition floors disregards the fact that the CPI-based mechanism negotiated by the parties results in attrition increases substantially less than compared to the traditional methodology proposed by PG&E, and supported by ORA.

Weil stated that Aglet supports the distribution and generation settlements that are the subject of the proposed decision of ALJ Halligan.

Description: On April 12, 2004, Brian Cherry, Director, Regulatory Relations, Pacific Gas & Electric Company (PG&E), met with Brian Prusnek, advisor to Cmmr. Kennedy, in San Francisco. Cherry discussed the proposed decision and stated that the Distribution and Generation settlements, including the attrition floors, represent a reasonable compromise of PG&E's, The Utility Reform Network's, and Aglet Consumer Alliance's litigation positions and should be approved without modification. Cherry stated that capital investment plans are not driven by the rate of inflation, and that attrition floors are a fair means to provide minimal funding for capital investments PG&E must make even during periods of no inflation or deflation.

Description: On March 24, 2004, Erik Jacobson, Chief of Regulatory Relations of Pacific Gas and Electric Company (PG&E), met with Julie Fitch, advisor to Cmmr. Peevey, in San Francisco. Also present were Mark Pocta, Manager, Energy Cost of Service, for the Office of Ratepayer Advocates, Patrick Golden, Attorney, Jan Berman, Director of Rates & Tariffs, for PG&E, and Robert Finkelstein, Executive Director, The Utility Reform Network. Golden described the issues covered by the GRC distribution and generation settlements. Golden stated that the Distributing Settlement resolves a number of customer service, accounting, record keeping and other issues raised by the settling parties. Berman explained the magnitude of revenue requirement reductions made in the settlements compared to PG&E's request. Berman stated that overall PG&E reduced its requested revenue requirement by approximately $67 million in the Generation Settlement, and an additional $305 million in the Distribution Settlement. Berman explained that the Commission decision regarding the pension contribution issue could affect these numbers.

Description: On September 30, 2003, Dr. Gail de Planque, Chair of the Diablo Canyon Independent Safety Committee (DCISC), met with Pres. Peevey and Mike Campbell, advisor to Cmmr. Lynch, in two separate meetings in San Francsico. At the meeting with Pres. Peevey, also present was Peter Arth, advisor to Pres. Peevey, and with Mike Campbell ? David Gamson, advisor to Cmmr. Brown, and Steve Weissman, advisor to Cmmr. Wood. Robert Rathie, counsel, and Diane L. Fellman, regulatory counsel, for DCISC, and representatives of the Office of Ratepayer Advocates, Pacific Gas and Electric Company (PG&E), and the Mothers for Peace, participated in both meetings. Written materials (attached to the notice) were used. Dr. de Planque stated that the Stipulation allowed for the Mothers for Peace issues concerning possible modification of the DCISC structure. Fellman indicated that the DCISC initiated the ex parte meeting due to the recent filing by the Mothers for Peace that violated the terms of the Stipulation. Dr. de Planque affirmed the DCISC?s support for the terms of the Stipulation and continuation of the DCISC at least until the next PG&E general rate case. De Planque expressed concern that the proposals of the Mothers for Peace to modify the DCISC structure were unclear and, if implemented, would contradict the character of the DCISC, as created under the original Diablo Canyon rate treatment settlement in D88-12-083, to act as a technical review committee rather than as a public advocate.

Wood, and David Gamson, advisor to Cmmr. Brown. Representatives from the Diablo Canyon Independent Safety Committee (DCISC), the San Luis Obispo Mothers for Peace (SLOM4P), and Pacific Gas and Electric Company (PG&E) participated in both meetings. Burns spoke about ORA's support for the continuation of the DCISC and about three of the four requests made by the SLOM4P: a fourth member on the DCISC from the public, removing PG&E from the selection process of committee membership, and expanded outreach by the DCISC.

Description: On September 23, 2003, Marc Joseph, attorney for the Coalition of California Utility Employees (CUE), met with Cmmr. Peevey in San Francisco. Also present were Julie Fitch, advisor to Cmmr. Peevey, and Art Carter, representing CUE. Written material (attached to the notice) was used. Joseph stated that CUE and Pacific Gas and Electric Company (PG&E) had reached a compromise on reliability performance incentives. Joseph stated that PG&E's reliability was bad and that average response time was getting worse. Joseph noted that PG&E was not subject to any existing reliability performance incentives and that CUE/PG&E proposal would require PG&E to meet increasingly stringent reliability benchmarks, and would be subject to rewards or penalties based on its performance. Joseph also described the additional revenue to be placed on a one-way balancing account to enable PG&E to meet the more stringent benchmarks, and how the proposal would return this money to ratepayers if PG&E's reliability does not improve.
