On April 5, 2005, Jennifer Dowdell, Manager, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with David Gamson, advisor to Cmmr. Brown, and Theresa Cho, advisor to Cmmr. Grueneich, in two separate meetings in San Francisco. Also present was Walt Campbell, Senior Director of Business and Financial Planning, PG&E. A document (attached to the notice) "PG&E's Petition for Modification of D04-10-037" was used. Campbell indicated that while both the Cmmr. Peevey's proposed decision (PD) and the alternate draft decision of ALJ Kenney corrected deficiencies in the original order that would prevent the Company's sale of rated securities, only the PD provided PG&E the flexibility to refinance its debt in a timely fashion, thereby minimizing costs to customers.

Campbell explained how restrictions in allowed short-term debt capacity and use of accounts receivable financing will limit the utilities access cash and potentially increase ratepayer costs. Campbell stated that accounts receivable financing is currently PG&E's most cost effective form of short-term financing. Warner discussed how project CEQA compliance is better managed through traditional approvals rather than in conjunction with a general financing order.
