Weissmann stated that the Commission should determine that Public Utilities Code Section 854(b) does not apply to this transaction because none of the parties to the transaction is a utility. Weissmann further stated that the Commission has discretion to exempt the transaction of Section 854(b) even if that statute otherwise applied. Weissman stated further that the draft decision correctly concludes that hearings were not required.

On October 27, 2005, Michelle Robinson, Vice President-Regulatory, Verizon California Inc. (Verizon), spoke via telephone with Brian Prusnek, advisor to Cmmr. Kennedy. Robinson stated that Verizon and MCI have cleared a hurdle at the U. S. Department of Justice (DOJ), and that the DOJ filed a consent decree for approval by a Federal court that includes stipulations agreed to by the companies. Robinson explained that under the decree, Verizon and MCI will lease dark (unused) fiber connections at specified locations and that none of the fiber connections subject to the decree are located in California.
