Description:
On October 2, 2006, Richard W. Clark, Director of the Consumer Protection and Safety Division (CPSD), met with Lester Wong, advisor to Cmmr. Peevey, in San Francisco. Also present was Patrick S. Berdge, staff counsel, CPSD. Clark and Berdge stated that it was essential that all parties remain open to all new settlement offers. Clark and Berdge explained that staff, while maintaining an open mind with regard to each such proposal, remains concerned that this is a high-speed passenger rail corridor with considerable accident history and, consequently, staff must be assured of the proposed crossing's safety. Clark and Berdge noted that staff did not have a previous agreement with the City of Glendale exchanging the Flower Street at-grade crossing for the Bekins Way and/or Allen Street at-grade crossing closures.

On March 27, 2006, Richard Clark, Director of the Consumer Projection and Safety Division (CPSD), met with Kelly Hymes, advisor to Cmmr. Grueneich, in San Francisco. Also present were Lester Wong, advisor to Cmmr. Peevey, Belinda Gatti, advisor to Cmmr. A copy of the map (attached to the notice) was used. The RCES staff described the difficulties with the safety of the proposed crossing and the increased train traffic and increased highway-rail crossing collisions on the Metrolink corridor. The RCES staff noted that these were material changes to the proposed at-grade crossing at Flower Street that required a new consideration of the safety of the crossing. The RCES staff noted that there are other crossings nearby that do not have the serious problems of the Flower Street crossing.
