On January 31, 2006, Mark Moench, General Counsel of MidAmerican Energy Holdings Company (MidAmerican), met with Robert Lane, advisor to Cmmr. Bohn, in San Francisco. Also present were Brent Gale, Senior Vice President of MidAmerican, Andrea Kelly, Managing Director for Strategy of PacifiCorp, and Michael B. Day of Goodin, MacBride, Squeri, Ritchine & Day, LLP, outside counsel for MidAmerican and PacifiCorp. Day explained the Applicants' concerns with the draft decision's (DD) requirement that applicants commit to waive their right to advocate a change in the regulatory treatment of the acquisition premium. MidAmerican and PacifiCorp endorsed the statement of the DD that both the costs and benefits of the acquisition should be allocated at the holding company level and urged the Commission to make this statement part of the order. Kelly and Gale also explained the Applicants' concerns regarding the DD's inaccurate treatment and characterization of Commitment 23 and Commitment C-14.
