Also present was Andrew Ulmer, Chief Council for DRA. DRA expressed agreement with the intent of the draft decision to provide for a partial exemption from Public Utilities (P.U.) Code §851 for incumbent local exchange carriers (ILECs) subject to the Uniform Regulatory Framework (URF). DRA also expressed support for the draft decision's proposal that the Commission consider in a future rulemaking a broader exemption for the URF ILECs from P.U. Code §851. DRA reiterated its position that transactions that might affect the provision basic exchange service should not be accorded an exemption from P.U. Code §851. Verizon urged the Commission to exempt all carriers regulated under the Uniform Regulatory Framework (URF) from the requirements of Public Utilities Code § 851 pursuant to § 853(b). Verizon discussed how § 851 is an outdated regulation that no longer serves its intended purpose, needlessly hampers routine real estate transactions, and is inconsistent with URF.
