Zafar explained that the ALJ proposed decision cites D.00-04-060 as its basis for imposing a 25% risk on SoCalGas' shareholders for any revenue shortfall as a result of this contract while ignoring the relevant precedent set in D.02-12-017. Zafar also discussed D.06-04-002. Zafar explained that it is not appropriate for the Commission to rely on an outdated decision. Zafar suggested that the discussion of the topic of risk should be in the BCAP and that the Commission should not raise the matter in this proceeding through the TAFT contract.
